In compliance with current legislation on data protection, users are informed that “ACE Japan” has adopted the technical and organisational measures in accordance with the provisions of said regulations. The personal data collected in the forms are processed solely by the staff of “ACE Japan” or by the Data Processors established herein. Appropriate security measures have been adopted for the data provided and, in addition, all technical means and measures within its reach have been installed to prevent the loss, misuse, alteration, unauthorised access and theft of the data provided to us.

Veracity of data 

The Client or User declares that all the data provided by him/her are true and correct and undertakes to keep them updated, informing “ACE Japan” of any changes to them. The user will be responsible for the veracity of his/her data and will be the sole party responsible for any conflicts or disputes that may arise from the falsity of said data. It is important that, in order for us to keep personal data updated, the user informs “ACE Japan” whenever there has been any change to said data. Otherwise, we cannot be responsible for its veracity.

Exercise of rights

The LOPD and the RGPD grant interested parties the possibility of exercising a series of rights related to the processing of their personal data. As long as the user's data is processed by "ACE Japón", they may exercise their rights. To do so, the user must provide documentation proving their identity (ID or passport) by email to acejapon@gmail.com, or by written communication to the address that appears in our legal notice. This communication must include the following information: Name and surname of the user, the request, address and supporting data.

The exercise of rights must be carried out by the user himself. However, they may be carried out by an authorised person as legal representative of the authorised party. In such case, documentation proving this representation of the interested party must be provided.

The user may request the exercise of the following rights:

• Right to request rectification (if incorrect) or deletion.
• Right to request limitation of processing, in which case they will only be kept by “ACE Japan” for the exercise or defense of claims.

If a user considers that there is a problem with the way ACE Japan is handling their data, they can direct their complaints to the Security Officer or to the corresponding data protection authority, the Spanish Data Protection Agency being the appropriate one in the case of Spain.

Disaggregated data will be retained without a deletion period. As regards Customer data, the retention period for personal data will vary depending on the service contracted by the Customer. In any case, it will be the minimum necessary, and may be kept for up to:

4 years: Law on Violations and Sanctions in the Social Order (obligations regarding membership, registration, deregistration, contributions, payment of salaries, etc.); Arts. 66 et seq. General Tax Law (accounting books, etc.)
5 years: Art. 1964 Civil Code (personal actions without special term)
6 years: Art. 30 Commercial Code (accounting books, invoices, etc.)
10 years: Art. 25 Law on the Prevention of Money Laundering and Financing of Terrorism.
Users of mailing lists or those uploaded by “ACE Japan” to social media pages or profiles will be retained until the user withdraws consent.

Candidate data (CV), if any: If the candidate is not selected, “ACE Japan” may store his/her CV for a maximum of two years to include it in future calls for applications, unless the candidate states otherwise.

Obtaining and processing data

“ACE Japan” is obliged to inform users of its website about the collection of personal data that may be carried out, either by sending an email or by filling in the forms included on the website. In this regard, “ACE Japan” will be considered the Controller of the data collected through the means described above.

As established by the LSSICE, “ACE Japón” undertakes not to send commercial communications without identifying them as such. For these purposes, information sent to customers for the maintenance of the existing contractual relationship will not be considered as commercial communication.

In any case, only the data required to perform the contracted service or to adequately respond to the information request made by the user will be obtained.

Personal data may sometimes be provided through links to third party websites. In this case, at no time will “ACE Japan” staff have access to the personal data that the Client provides to such third parties.

“ACE Japan” has a profile on the main social networks on the Internet (Facebook, Twitter, LinkedIn, YouTube), and in all cases it acknowledges that it is the Data Controller of its followers, fans, subscribers, commentators and other user profiles (hereinafter, followers) published by “ACE Japan”. The processing that “ACE Japan” will carry out with said data within each of the aforementioned networks will be that which the social network allows for corporate profiles.

“ACE Japan” may inform its followers, when not prohibited by law, by any means permitted by the social network about its activities and offers, as well as provide personalized customer service. Staff Selection 

Any candidate who sends electronic communications to “ACE Japan” in order to access the Entity’s staff selection processes authorizes us to analyze the documents sent (for example, the CV), all the content that is directly accessible through Internet search engines (for example, Google), the profiles maintained on professional social networks (for example, LinkedIn), the data obtained in the entrance exams and the information revealed in the job interview, in order to assess his or her candidacy and, where appropriate, offer him or her a position. If the candidate is not selected, “ACE Japan” may keep his or her CV stored for a maximum of two years, to include it in future calls for applications, unless the candidate states otherwise.

Communication of information to third parties

“ACE Japan” will not transfer or communicate your data to any third party, except in cases provided for by law or when the provision of a service implies the need for a contractual relationship with a data processor, and always in accordance with the general conditions approved by the user prior to contracting the same.
